SK prexy's ex-officio authority questioned

During the regular City Council session on Tuesday, Councilor Agapito del Rosario placed under a "question of credentials" SK federation president and ex-officio Councilor Randy Mallari.
"Those that elected Mallari as SK president are all out of their currents posts now, there are new SK officers in all 33 barangays, how can Mallari continue to serve if the people who have voted for him are beyond the reasonable age for the SK," del Rosario said.
While the issue is not yet resolved, del Rosario wants Mallari to be placed under "audience" status.
Local Government Officer Flordeliza Trinidad said while Mallari's successor is not yet determined, he could still act in a "hold over capacity." He said the SK Federation has yet to elect its new president.
However, del Rosario was not convinced with
Councilor Jay Sangil presented an August 13, 2002 en banc ruling of the Supreme Court to justify Mallari's continued term of office. "It is clear in this ruling that before and after the SK election the incumbent is still in a 'hold over period' until his successor is elected by his peers," he said.
Del Rosario was satisfied with Sangil's explanation.
In his valedictory address, Mallari thanked the members of the council for their support to the different endeavors of the SK.
Mallari expressed his feelings over how del Rosario acted in the last days of his term in SK president and ex officio member of the City Council, "I' m very disappointed since despite my short stint I have been with him in the council."
Mallari, who has been in government office since 2004, has been active in youth programs as SK chairman of Barangay Salapungan. He was eventually elected as president of the SK Fedaration here, which earned him a seat in the City Council as ex-officio member.
Mallari is set to officially vacate his post after the new SK Federation president is elected on Thursday.
